Realeyes’s legitimate interest is its business needs to provide an aggregated use report for the Realeyes customers ("market research" or "media analysis service”), including quality assurance, to its customers to help optimise our customer’s content. This need is balanced against your rights and freedoms. Broadly speaking legitimate interests means that we process your personal information (i.e. facial image, device data and other data that you share with us) based on the said genuine and legitimate reason and we are not harming any of your rights and freedoms. In our evaluation we have assessed considerations of the risks present in our processing, your likely response to those risks (unless you inform us of your actual considerations) and what benefits you are likely to receive from our processing.

You may ask us at any time to delete your Personal Data by contacting us at info@realeyesit.com requesting erasure of your personal data.

We need your consent to process your personal data for software improvement purposes

Please review the consent terms below and read about Realeyes OÜ Privacy Policy and use of cookies. In the following, please note that the term „software improvement” means both software improvement, software development and related research (R&D) purposes as well.

The data controller processing your personal data is Realeyes OÜ (having its registered seat at Vahe 15, Tallinn 11615, Estonia).

What kind of data do we collect?

Your facial image, device data (including IP address) and other data you share with us (“collectively referred to as ‘Study Data’). For further details please refer to section titled “What Personal Information do we collect?” in our Privacy Policy.

What do we use it for?

We use your data anonymously for software improvement purposes.

Is any biometric data collected or created during processing?

We do not collect any biometric data of you besides your facial image on the video. However, our machine learning models are being trained to be able to tell if the same individual appears on two separate photos or not. These models are built and trained on datasets of real data, such as your facial data that we collect.

Facial images as such can be considered as biometric data, if the following three conditions are met:

a) data relating to physical, physiological or behavioural characteristics of a natural person (including facial images);

b) such personal data results from specific technical processing of data set out in a); and

c) personal data is used to uniquely identify a natural person.

Our purpose is to improve our machine learning model in a way that it will be capable of uniquely differentiating one natural person from another one, but currently, our purpose for using your facial images is not to uniquely identify you, but to properly train our machine learning models.

Can your research and development team identify me?

The research and development team don’t have any other information about you and does not intend to uniquely identify you in any other way.

Do we share it with anyone?

We work with trusted partners, bound by strict confidentiality obligations to perform tasks on our behalf and we may need to disclose Personal Information to them so that they can perform these tasks. These tasks include website hosting, content management services, technology and communications platform providers and providers of website analytics, annotation service providers. We may also share your Personal Information with our group entities, affiliates, direct and indirect licensees.

Where do we store the data?

Your data is stored within the European Economic Area in secure locations, protected against unauthorized disclosure or processing. We may transfer your data to a third country if the European Commission has decided that this third country ensures an adequate level of protection or we have employed additional safeguards to protect your data.

How long do we keep your data?

We store Personal Information for as long as it is required for our research and business purposes stated above and as required by law. If you request deletion of any of your Personal Information (see right to erasure as set out below), we will delete that particular data within 30 days of receipt of your request.

What can you do about this after the test?

You can request to see your personal data that we hold or have it deleted or corrected.

How do we use cookies?

A cookie is used within the web browser, creating a participant ID, this enables us to identify you in case you wish to see the data we hold of you.

Can you withdraw the consent?

You have the right to withdraw your consent to processing of your personal data at any time by contacting us at info@realeyesit.com.

Ownership of Study Data

As between you and Realeyes, you agree that Realeyes OÜ solely owns all right, title and interest in and to the Study Data including all intellectual property rights therein, and you hereby assign to Realeyes OÜ all right, title and interest (including all intellectual property rights) you may own or possess in the Study Data and, to the extent permitted under applicable law, you waive any non-assignable rights you may have therein in favour of Realeyes. To the extent you retain any right, title, or interest in the Study Data you hereby grant Realeyes OÜ a perpetual, worldwide, transferable, sublicensable, royalty-free right and license to use, distribute, reproduce, modify or otherwise create and use derivative works from, disclose, and publicly perform/display such items, irrevocably and in all formats and media existing now or in the future, to the maximum extent permitted under applicable Law. You further waive any right to approve the Study Data or any future use of the Study Data, any right of publicity or image in the Study Data, and any right to enjoin or otherwise impair Realeyes’ or its direct or indirect licensor’s use of the Study Data.
